Terms of Service — Baby What?

These Terms of Service (“Terms”) govern your use of Baby What?. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the App. By using the App you confirm that you meet this requirement and that the information you provide is accurate.

2. Your account

You can create an account with an email address and password, or by signing in with a third-party provider you choose (such as Google or Apple). You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorised use. You may delete your account at any time in Settings → Account → Delete account.

3. The service

Baby What? helps you discover baby names, save and organise the names you like, view insights about your preferences, rank names, and — if you choose — connect with a partner to find names you both love. Some features are free and others may require a paid unlock. We may add, change, or remove features at any time.

4. Partner features

Partner connection is optional. If you connect with a partner, certain information is shared as described in our Privacy Policy — including your display name and any names you have both loved (“matches”). Only connect with people you trust. You can disconnect a partner at any time.

5. Purchases

The App may offer an optional one-time paid unlock for additional features. Prices are shown in the App before you buy. Purchases are processed by the app store you downloaded the App from (the Apple App Store or Google Play), under that store’s terms — we do not process or store your payment details. The paid unlock applies to the account that made the purchase.

Refunds and cancellations are handled by the relevant app store in accordance with its policies and applicable consumer law (including the Australian Consumer Law where it applies). If you believe you are entitled to a refund, contact the app store or us at [email protected].

6. Acceptable use

You agree not to:

use the App for any unlawful purpose or in violation of these Terms;
attempt to access accounts, data, or systems that are not yours;
interfere with, disrupt, probe, or overload the App or its infrastructure;
reverse engineer, scrape, or copy the App except as permitted by law; or
misuse partner invite codes or attempt to connect with someone without their consent.

7. Name data and accuracy

Name meanings, origins, pronunciations, popularity rankings, and similar information are provided for informational and entertainment purposes only. They are drawn from public and third-party data sets, may be incomplete or inaccurate, and should not be relied upon as authoritative. You are solely responsible for any naming decisions you make.

8. Your content

You retain ownership of the information and lists you create in the App. You grant us a limited licence to store, process, and display that content as needed to operate the App and provide the features you use (including partner matching). You are responsible for the content you submit.

9. Intellectual property

The App, including its software, design, branding, and original content, is owned by Steady Labs or its licensors and is protected by applicable laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the App.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION IS ACCURATE OR COMPLETE. NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY GUARANTEE, RIGHT, OR REMEDY YOU HAVE UNDER THE AUSTRALIAN CONSUMER LAW OR OTHER LAW THAT CANNOT BE EXCLUDED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Steady Labs WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR A$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or to protect the App or its users. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination will survive.

13. App stores

If you download the App from the Apple App Store or Google Play, your use is also subject to that store’s terms. The app stores are not responsible for the App or its content, and are not parties to these Terms. Where Apple’s standard Licensed Application End User License Agreement applies, it supplements these Terms, and Apple and its subsidiaries are third-party beneficiaries with the right to enforce these Terms against you.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Victoria, Australia, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Victoria, Australia, unless applicable law requires otherwise. Nothing in this section limits any mandatory consumer protections available to you in your country of residence.
